May 1, 2011 Petition for writ of certiorari denied
Hello Everyone,
Our apologies for such a long gap since the last update. In April of 2010 we wrote you to let you know that Brandon's last appeal was denied. While that truly was his last appeal, there was one more legal plea to be made, this time to the Supreme Court. The document is called a petition for a writ of certiorari and essentially asks the Supreme Court to review the decision of a lower court.
They denied the petition on April 21, 2011. We, and especially Brandon, had little faith in this last legal effort as the courts have failed him at every turn (though we did appreciate the work it took Brandon's attorney to file it). We are sad but not downhearted as we continue our planning for a campaign to ask for Governor Brown's help. As soon as we have more information we can share, we will post it here on Brandon's site for you.
Meanwhile, Brandon is doing okay. He continues to paint and exercise, and he has friends and loved ones in his life who are enriching his visits with laughter and caring. Brandon wants to update you personally and plans to write a new letter soon.
So, here we are in May 2011, nearly sixteen years after this nightmare began:
Warmest regards,
Gene and Janice Hein

So, here we are in May 2011, nearly sixteen years after this nightmare began:
- Brandon is 34 years old and has spent almost half his life in a maximum security prison for underage drinking and participating in a teenage brawl in which another boy was tragically, but unintentionally, killed.
- His original sentence was reduced by former Governor Schwarzenegger from Life Without the Possibility of Parole to Twenty-nine years to Life. (Brandon must serve 85% of that sentence before he has a chance at parole.)
- Brandon's story has been told around the world and so often we hear from supporters who ask, "Why is he still in prison? Why can't someone right this injustice?"
Warmest regards,
Gene and Janice Hein

Dear Mr.and Mrs. Hein and Brandon. I am shocked and outraged after watching the documentary on the case. I pray for you and your family.
I'm a retired police investigator. I investigated homicides in a large midwestern city for 7 years. I watched a show on Netfix today documneting this case.
I am embarrassed to have been associated with a legal system that can do what was done to these young men.
What should have been prosecuted as manslaughter was ballooned into a felony murder case in an effort to make careers and make examples out of the suspects involved in the incident.
While they were not angels by any means they do not deserve to be in prison for the rest of their lives.
Like the West Memphis Three, this is a miscarraige of justice to the max.
Dershowitz as usual is over the edge - referring the death of the vicitm as an "accident" that in some cases wouldn't result in any charges is a stretch but he makes good point too.
I just saw the documentary on Netflix. I want to let you guys know that I really admire what it takes to fight everyday for your son's freedom. Keep it up! I'm not sure what can help you guys from a support standpoint, but I'm telling everyone I know to check out the movie and this site.
God Bless!
I am still in shock after watching the documentary,I am appalled and saddened by the injustice done. I will keep you all in my prayers...
I watched the documentary about Brandon. I am a retired dispatcher and would LIKE to believe in the system....but, as i watched this show...there was so much hatred in Jimmy's eyes....I am so sorry for you and your son. Our kids do dumb stuff...so, "but by the Grace of God...there go I"...my prayers are with you, your son, and the other families....May God right this wrong.....
I watch the the doc. Of this case, and this an out rage! Brandon seems like a typical teen as well as the others involved. Jimmy farris was taken to early, but accidents happen, and I clearly believe that's exactly what happen. This is injustice, our justice system tells me that casey anthony can kill her child and go free, along with oj and everyone eles. These boys are clearly paying for the mishaps of everyone eles the DA screwed up on, and its very sad. I thought being african american was hard, but these kids must be the african americans of that suburb, so they get treated like we usualy would. I guess you get special treatment when your a cop. I'm sorry, my heart goes out to all the defendents, and their familys. Keep your heads up God will set them free, one way are another.
Hi I am Jeniel Addington . My son Troy Fava was convicted of first degree murder when the courts knew he was no0t the shooter. He was sentenced to 35 years to life....
