Status Update: November 20, 2011

Hello Everyone,

Where have we been? It's been a long time since we've posted. Our last post had so much to say about how badly broken our courts and appeals systems are that it seemed to need its own time to speak. If you haven't read it, please do.

What now? Even though Brandon's last appeal was denied, we are still here quietly fighting hard for his release. We love Brandon and we will never give up. When we have anything we can share with you, we will. Until then, your emails and letters of support are more help than you can know.

How is Brandon? He's okay. He paints, he reads, he exercises. He tries to stay strong in the face of all the setbacks and disappointments. He is grateful for the love of family and friends to see him through each day that passes.

Hi.. I am not sure why, but I look here ever so often to see if anything has changed in this case. I think the worst thing about it all was he was just a young kid when this happened. The court system took away his youth. Now he is a grown man and can never relive everything he missed. Something about this story touched my soul in a way I cannot explain. I am sure that there is a lot of people who look at him as just another person. For some reason I can't escape the realization that he isn't and did not deserve this. That a person's life can be ripped from them. It is good that you have not given up hope, and I really hope you continue to fight. Always seems that after awhile everything becomes normal and everyone just gets used to the way things are. But this is not normal or right by any means. I hope you keep this updated.

Hello, I am a law student at Ohio Northern University. I just finished watching a documentary on Netflix about your son's conviction and sentencing. My heart goes out to you and Brandon. In law school we are taught the fundamentals of criminal procedure along with the inner working of the 'justice' system. The 'felony murder' rule was given much attention in class, because it was so hard to comprehend. My classmates and I raised a series of hypotheticals trying to grasp the magnitude of the law. It seemed inherently wrong. Although, there are circumstances when it seems justified, your son's case raises the obvious oversight made by lawmakers when implementing this law. Seperate from the law itself, the ethical violations that were present in the courtroom are morally reprehensable. Many crimes are judged and weighed by the heinousness of the defendant's actions. It is incomprehensible to me that a judge having seen violent, pre-meditated rape and murder, could look at your son as a teenager, and tell him that he belongs in prison for the rest of his life. I am 32 years-old, and a mother of 3 children. I can't say that at Brandon's age I was doing anything different than he was. However, given the chance to mature, I turned my life around. I am so sorry that he has not been given this chance. I wish there was something I could do to help. I commend your strong will, and devotion to your son. Good luck.

hi, my name is tawni. i came across this web site when i googled "how to write to the governor." first i want to say i admire your strength and efforts. my son was charged as an adult at 16 for his first offence and sentenced to 8yrs in prison. ive had a really hard time continuing my life. i see no reason to laugh, celebrate, even live. i know that sounds extreme but ive been devestated. he didnt hurt anyone, he followed the intstructions of older boys (18 yr. olds) to hold an unloaded gun in order to scare and humiliate another 18 yr old boy. the motive, the victim slept with one of the other boy's girlfriend. the other 18 yr old boys who participated in this crime also were convicted, but recieved a sentence of half the time my son recieved, despite the fact that the other boys were adults, planned the crime, recruited my 16 yr old son and furnished him with the unloaded gun.i feel so helpless, but also feel that i cant just do nothing. he's served over 2yrs already. im scared for his life and his future. he's also got two strikes from these charges. when will the government realize the system isnt working? i need some direction..

My son was arrested when he was 20. They threatened my son with the Felony Murder Rule. Till this nightmare I had never heard about it.
Since then I have read everything about Brandon I can find.Where is the America I grew up in? You can be convicted on someone's intent even if you knew nothing about it?
My son was 20, mentally ill no police record at all. The man also there that night is 50, is a two striker, cdc# since 1973, his DNA was on the murder weapon not my son's and he walks not even charged.
My son got a "deal" of 12 years. To add insult to injury they added an extra year weapon enhancement. For the weapon the other mans DNA was on!
They told him if he didn't sign they would invoke the FMR and he would be eligible for the death penalty. That they didn't have to prove intent only that he was there and they "probably" wanted to rob this guy although there was no proof he was robbed.
Does anyone have a fair chance at a "Jury of Your Peers" anymore?

Hello! I just stumbled across your site and was unfortunately not shocked by the actions of those in our "justice" system. I too was raked over the coals for allegedly committing a crime against a family member of a police officer. These people are a cult, no bones about it. They are more worried about achieving their personal agenda than ensuring justice. I was wondering if you have considered all the social media outlets such as facebook, and twitter? I would be more than willing to volunteer my time in assisting with this case. Also I was thinking about a "slap" campaign to further the
" Who is BrandonWeiden" idea. "slaps" are stickers which are placed all over the world by many people. You could sell slaps as a fundraiser and also spread the info on this horrible injustice! Thanks for your time and my prayers are with you all!!

Hi, This isn't really a comment to this post, but just to let you and Brandon know that there are people out here who appreciate his art and regularly check for any additions. I write this in the hopes that this provides some small measure of comfort or satisfaction for Brandon, in what must be some very difficult times for him and for you.
